CALL TO ORDER
Mayor Switzer called the meeting to order at 7:04 PM.
APPROVAL OF AGENDA
Motion by Gallagher, second by Swartwood, to approve the agenda. Motion Carried Unanimously (MCU)
CONSENT AGENDA
a. Regular Minutes of July 8, 2024
b. Pay Voucher No 2 Forest and Depot Project $142,128.13

REGULAR AGENDA
a. Consider Approving Draft 2025 Capital Improvement Plan
Motion by Swartwood, second by Gallagher, to approve the 2025 Capital Improvement Plan. MCU
b. Consider Request from Millstone Square Townhome Association and Millstone Twinhome Association
Staff reviewed the request from the Millstone Square Townhome Association and the Millstone Twinhome Association for reimbursement of payment to repair a leaking curb stop box that is tied to the Associations irrigation system. Staff met with the Association representatives and shared the only records on file with the City that show the curb stop box in question was installed by the original developer, only to be abandoned when a subsequent developer finished the project. The curb stop box is outside of any easement or right-of-way which further supports the City’s denial of reimbursement. Staff supplied the City Council with a copy of the denial letter from the City’s insurer, the League of Minnesota Cities Insurance Trust (LMCIT).
Eric Teachout, 412 Archibald Lane and representing the Millstone Square Townhome Association appealed the decision by staff and the LMCIT saying that a lack of record keeping should not be the reason why the City Council would deny the reimbursement.
Mayor Switzer responded that the lack of records was not the only reason for the denial, rather it was the fact that the box is outside of the easement/right-of-way and that curb stop boxes are not directly connected to irrigation systems, so all signs point to this particular curb stop box being a private utility.
REPORTS OF OFFICERS, BOARDS AND COMMITTEES
City Engineer – Dustin Tipp
Tipp reported that Depot Street received the final lift of asphalt on Friday, July 19 while Forest Ave will receive the final lift by the end of this week depending on the weather.
Timm’s Trucking is on-site and preparing to pave the dog park parking lot – and install curb and gutter and install a water line.
Work Session
a. Draft 2025 General Fund Budget
Staff reviewed the first draft of the 2025 General Fund budget and highlighted some of the planned projects that are included in the CIP and the draft 2025 general fund budget. Further refinement will take place over the next couple of weeks, with it being back before the City Council at their meeting on August 12.
